The Secret to Forcing Your Boss to Treat You Fairly At Work
Even if you don't like the notion that
people can legally be fired for no reason (except in Montana), you must understand it. Only if you first understand employment at-will can you then learn
how to protect yourself from a bad boss who wants to use it against
you.
Employment at will is not fair; it does not
even try to be fair. But, you can get "fair" treatment at work by
using the exceptions to employment at will.
You should never rush into the workplace as
a pure "at-will" employee without any protection from the slings and
arrows of your supervisors.
You can protect yourself with the armor of
exceptions to employment at will. You will learn how to fit
into this armor. Then, when your supervisors try to discipline
or terminate you, their unwarranted attacks will be deflected and
blocked.
If
you apply what you learn in Work Laws Exposed, anytime your
supervisors attack you it will be obvious that they are attacking
you for an illegal reason. Be aware, however, that you cannot
put on the first piece of armor you see and assume you will be fine. Each piece of armor is different, and not all of them will fit you.
Each piece of armor is one of the illegal reasons for terminating an
employee.
The exceptions to employment at will are
like the different types of people who are not supposed to be shot
and killed on the battlefield during a war. Perhaps you have heard
of soldiers from one side during the Gulf War pretending to be
medics, so they could travel during the day and not get shot at.
Or caravans of munitions being carried in trucks marked with a big
white plus sign, so the other side would think the trucks were only
carrying medical supplies. According to the rules of war,
medics and caravans of medical supplies should not be attacked.
This is the first and most powerful strategy
for protecting yourself at work, except you are not going to be
dishonest about it. You are going to learn the workplace
equivalent of actually carrying medical supplies and being a part
time medic, so it will be illegal for your workplace enemies to
attack you.
In legal terms, if it is illegal to
terminate a group of people because an exception to at-will
employment applies to them, then that group is called a "protected
class." For instance, one exception to employment at will is
that it is illegal to terminate someone because of their race. All
racial minorities, then, are said to be a "protected class."
Employment law does not limit you to just
one protected class. It is perfectly acceptable to be a part
of multiple protected classes. The law recognizes that being a
part of multiple groups is a natural part of life. The law
expects you to be a part of more than one group. So by all
means, look around and find a few groups that are "protected
classes" - which means, a group that cannot be terminated from their
jobs "at will." Then, join that group and put on the group's
armor to protect yourself from the whims of your supervisor, bosses,
or even a downturn in the economy.
Most people do not understand that "at-will"
employment means, "Anyone can be terminated at any time, for any
reason, just not an illegal reason - and "illegal reason" means
disciplining or terminating someone because they are part of a
protected class." Most people believe that "fair" should just be the
rule. Now you know the difference, and you will be able to join
protected classes. Like a soldier who drives a medical supply truck,
it will now be illegal to attack you when you are on the battlefield
of your workplace.
Work Laws Exposed will teach you about the
different types of groups that cannot be attacked on the battlefield
of your workplace, and you are going to begin identifying the
protected groups that fit you.
With a little explanation, you can make at
least three of the pieces of armor, the illegal reasons for
discipline or termination, fit you perfectly. Get Work Laws
Exposed to learn how.
